Push Supplements Affiliate Program Terms of Service

  1. Introduction

Welcome to the Push Supplements Affiliate Program (“Program”). By participating in the Program, you agree to comply with the following Terms of Service (“Terms”). Please read them carefully before applying or promoting our products.

  1. Eligibility and Enrollment
  • Eligibility: The Program is open to individuals who are at least 18 years old and reside in the United States. There are no specific industry restrictions; however, we reserve the right to decline applications at our discretion.
  • Application and Approval: All prospective affiliates must submit an application through our designated platform. Approval is required before any promotional activities can commence. We utilize the Solid Affiliate platform to manage and track affiliate activities.
  1. Affiliate Responsibilities
  • Promotion: Affiliates are expected to promote our product, Daily Energy, in a truthful and ethical manner. False advertising, misleading claims, or any form of deceptive marketing is strictly prohibited.
  • Compliance: Affiliates must adhere to all applicable laws and regulations, including but not limited to the Federal Trade Commission (FTC) guidelines on endorsements and testimonials. Proper disclosure of the affiliate relationship is mandatory.
  • Content Creation: While Push Supplements will provide some marketing materials, affiliates are responsible for creating the majority of their promotional content. All content must accurately represent our products and brand.
  1. Prohibited Activities

Engaging in any of the following activities may result in immediate termination from the Program and forfeiture of any outstanding commissions:

  • Deceptive marketing practices.
  • Violation of intellectual property rights.
  • Promotion of illegal activities.
  • Providing false or misleading information.
  • Artificially inflating sales or traffic.
  • Failing to disclose affiliate relationships properly.
  • Any activity that could damage Push Supplements’ reputation or violate legal requirements.
  1. Commission Structure and Payment
  • Standard Commission: Affiliates will earn a 20% commission on the net sales of Daily Energy products generated through their unique affiliate links or assigned coupons. This rate is subject to change at the company’s discretion.
  • Payment Terms: Commissions are paid on a Net 30 basis, meaning payments are issued 30 days after the end of the month in which the sale occurred. This allows for the processing of returns, chargebacks, and fraud detection.
  • Payment Method: Payments will be made via PayPal, Stripe or a specified platform discussed proper between the company and the affiliate. Affiliates are responsible for providing accurate payment details.
  1. Tracking and Attribution
  • Tracking Mechanism: Sales are tracked using the Solid Affiliate platform, which utilizes cookies to attribute sales to affiliates.
  • Cookie Duration: The default cookie duration is 30 days, meaning affiliates will receive credit for purchases made within 30 days of the initial referral. This setting is configurable within the Solid Affiliate platform.

  • Attribution: If a customer clicks on multiple affiliate links, the most recent link clicked will receive the commission (last-click attribution).
  1. Affiliate Links and Coupons
  • Affiliate Links: Affiliates will be provided with unique referral links generated through the Solid Affiliate platform. These links must be used to ensure proper tracking and attribution.
  • Coupons: Affiliates may use discount codes generated within the Solid Affiliate platform. These codes are linked to the affiliate’s account and will attribute sales accordingly.
  1. Termination
    • Voluntary Termination: Affiliates may terminate their participation in the Program at any time by notifying Push Supplements in writing.
    • Involuntary Termination: Push Supplements reserves the right to terminate any affiliate’s participation in the Program at its sole discretion for any violation of these Terms or any conduct deemed harmful to the company’s reputation, brand integrity, or legal standing. If an affiliate is terminated, they will be entitled to receive any unpaid commissions earned prior to the violation. However, Push Supplements will not be responsible for paying commissions on any sales that were generated through false claims, misleading advertising, deceptive marketing practices, or any other violations of these Terms. Furthermore, Push Supplements is not responsible for any false, misleading, or unlawful claims made by affiliates. Affiliates agree to indemnify and hold Push Supplements harmless from any legal claims, damages, or liabilities resulting from their actions, including but not limited to regulatory fines, lawsuits, or consumer complaints arising from misleading or deceptive marketing tactics.
  1. Tax Obligations

Affiliates are responsible for complying with all applicable tax laws and regulations. Push Supplements does not withhold taxes on behalf of affiliates. Affiliates should consult with a tax professional to understand their tax obligations.

  1. Modification of Terms

Push Supplements reserves the right to modify these Terms at any time. Affiliates will be notified of significant changes via email or through the affiliate dashboard. Continued participation in the Program constitutes acceptance of the revised Terms.

  1. Limitation of Liability

Push Supplements will not be liable for indirect, incidental, special, or consequential damages arising in connection with this Program. Our total liability will not exceed the total commissions paid or payable to the affiliate under this Agreement.

  1. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.
